Chery Motor Australia Pty Ltd (CMA) provides access to the Chery Vehicle Technical Repair Information and Services Portal (CMA Portal) via a subscription, in accordance with the Motor Vehicle Service and Repair Information Sharing Scheme Act 2021.

These terms and conditions apply to the access, viewing and use of the CMA Portal, which includes the purchase of goods or services, and you agree to be bound by these terms and conditions upon entering the CMA Portal. Upon subscription, you acknowledge to abide by all warnings and cautions contained within the CMA Portal, as, to the maximum extent permitted by law, CMA does not accept liability for any claim, loss, damage, or injury emerging from the incorrect use of the information provided.

The service and repair information available on the CMA Portal has been provided for use strictly by a suitable and qualified person with access and knowledge of using the relevant prescribed tools and equipment. The information provided has not been intended for use by members of the general public, and it is strongly advised that one should not attempt to carry out any repairs if they do not understand any part of the given information, or do not have access to appropriate tools and/or equipment.

The service and repair information on the CMA Portal is only applicable to vehicles imported and distributed by CMA in Australia, and is not suitable for vehicles sold in, or imported from, other countries and/or markets. Any depictions of Chery vehicles and equipment have been designed, approved and manufactured in accordance with Australian specifications.

All information provided on the CMA Portal will be interpreted and governed solely by the laws of New South Wales, Australia.

Use of the CMA Portal and associated service and repair information is at the user’s own risk. To the maximum extent permitted by law, CMA makes no warranties of any kind, express or implied, with respect to the information provided on this platform. Notwithstanding this, access to service and repair information within the CMA Portal will only be granted based on an assessment of whether the requesting party is a fit and proper person to access the relevant information.

Service and repair information published on the CMA Portal will be updated from time to time, and users are required to use the latest information when carrying out repairs.

You acknowledge and agree that any name, logo, trademark or copyright contained on the CMA Portal is owned and licensed by CMA and may not be used by you without prior written approval. Your access to the information is intended to allow the repair or service of a Chery vehicle and for no other purpose. You are not permitted to copy or reproduce any information from the CMA Portal without express written consent. Doing so is prohibited and a breach of the law. The information and materials contained on the CMA Portal may not be resold or redistributed to any third party without CMA’s prior written consent. In the event of your unauthorised use of the CMA Portal, information and materials, CMA will aggressively enforce its rights at law, including but not limited to its intellectual property law, privacy and publicity rights.

Although CMA intends that information contained on the CMA Portal is current, accurate, complete and reliable, CMA makes no warranty or representation that this is or will be the case with respect to any such information, and to the maximum extent permitted by law, assumes no liability if this is not the case. Any typographical, photographic or other error in any information contained on the CMA Portal, including, without limitation, any product description, or the terms of offer of a product, is subject to correction and verification by CMA. CMA and its service provider partners are not responsible for any delay or failure in the performance of the information provided on the CMA Portal, if such failure or delay could not have been prevented by reasonable precautions, including where such failure or delay is caused by acts of nature, or forces or causes beyond our reasonable control. Examples include public utility, cellular service failure, failures of third parties, acts of war, government actions, terrorism, civil disturbances, cyberattacks, labour shortages or difficulties (regardless of cause), weather events, or equipment failures including internet failures, computer failures, telecommunication issues or other equipment or technology failures.

Upon registration and subscription to the CMA Portal, the user will be provided with a unique username and password that provides access to their account. You are solely responsible for maintaining the confidentiality of your CMA Portal account details, as well as any and all activities that occur under your account details.

If the user is a qualified motor vehicle mechanic who is accessing the information for the purpose of servicing and/or repairing a Chery vehicle, you acknowledge and accept that you will be legally accountable for the quality of the work conducted on the vehicle, regardless of any limitation to access of the information contained on the CMA Portal or other unforeseen circumstances. It is recommended that genuine Chery parts are used for any repair and/or service of a Chery vehicle.

Where a user is required to provide their personal information upon registration of the CMA Portal, this information will only be used to supply the service, goods and information requested by the user, and for any other reasonable uses where applicable. CMA reserves the right to amend these terms and conditions at any time and such amendment will apply upon publication on this website.
